{"id":199147,"date":"2026-08-03T03:51:25","date_gmt":"2026-08-03T09:21:25","guid":{"rendered":"https:\/\/newslink360.space\/?p=199147"},"modified":"2026-08-03T03:51:25","modified_gmt":"2026-08-03T09:21:25","slug":"student-protests-supreme-court-clarifies-states-can-close-withdraw-firs-against-protesters","status":"publish","type":"post","link":"https:\/\/newslink360.space\/?p=199147","title":{"rendered":"Student Protests : Supreme Court Clarifies States Can Close\/Withdraw FIRs Against Protesters"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p style=\"text-align: justify; \">The Supreme Court on August 3 clarified that the States are at liberty to close or withdraw the FIRs, in accordance with law,  against students over their participation in the student protests.<\/p>\n<p style=\"text-align: justify; \">The Court clarified its <a href=\"https:\/\/www.livelaw.in\/top-stories\/supreme-court-to-order-sit-probe-into-student-protest-violence-directs-release-of-detained-students-with-no-criminal-background-543164\" target=\"_blank\" rel=\"noopener\">July 28 order, <\/a>which had observed that the States can proceed with the investigation in the FIRs. The Court made the clarification today after petitioners pointed out that the July 28 order can impede the withdrawal of FIRs, which was a commitment made by the Union to the Cockroach Janata Party leaders as a condition to end the protests.<\/p>\n<p style=\"text-align: justify;\">The bench comprising <b>Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V Mohana<\/b> also clarified that the term &#8220;criminal antecedents&#8221; in the July 28 order means only &#8220;grave and heinous offences&#8221;. In the July 28 order, the Court had barred coercive action against students who did not have &#8220;criminal antecedents&#8221;. The Court clarified the expression after it was told by the petitioners that the term was vague and could cause difficulties to students who may have petty offences.<\/p>\n<div class=\"inside-post-ad-2 inside-post-ad ads_common_inside_post\" id=\"inside_post_content_ad_2\">\n<div class=\"ad_unit_wrapper track-click desktop-ad\" data-label=\"insidecontent\" data-category=\"banner_ad\">      <a href=\"https:\/\/www.livelawbiz.com\/?utm_source=website&amp;utm_medium=inside+content2&amp;utm_campaign=LLBiz_Live&amp;utm_id=SCDigests\" target=\"_blank\" rel=\"noopener\">          <img decoding=\"async\" src=\"https:\/\/www.livelaw.in\/h-upload\/2026\/07\/02\/683702-llbbanner-01jpg.webp\" alt=\"\" class=\"insidecontent-ad-img\" width=\"728\" height=\"220\"\/>      <\/a>  <\/div>\n<div class=\"ad_unit_wrapper track-click mobile-ad\" data-label=\"insidecontent\" data-category=\"banner_ad\">      <a href=\"https:\/\/www.livelawbiz.com\/?utm_source=website&amp;utm_medium=inside+content2&amp;utm_campaign=LLBiz_Live&amp;utm_id=SCDigests\" target=\"_blank\" rel=\"noopener\">          <img decoding=\"async\" src=\"https:\/\/www.livelaw.in\/h-upload\/2026\/07\/07\/684816-llb-bannerjpg.webp\" alt=\"\" class=\"insidecontent-ad-img\" width=\"320\" height=\"100\"\/>      <\/a>  <\/div>\n<\/p><\/div>\n<p style=\"text-align: justify;\">The Court was hearing petitions over the violence in the &#8216;Chalo Sansad&#8217; march held by the CJP protesters on July 20. While one set of petitions seek action against police officials who allegedly used excessive force on protesters, another set of petitions seek action in respect of the injuries allegedly sustained by officers from the side of protesters.<\/p>\n<p style=\"text-align: justify;\">At the outset, <b>Solicitor General of India Tushar Mehta <\/b>submitted that there was some confusion regarding how to implement the Union&#8217;s commitment to withdraw the FIRs against students. While the Government was serious about its commitment, there was some confusion regarding the &#8220;semantics&#8221;, as the criminal law has no option to withdraw an FIR. There can be the option to file a closure report, or to file an application to withdraw the prosecution, or the Courts quashing it. The SG said that he had a discussion with <b>Advocate Vrinda Grover<\/b> regarding how to legally enforce the commitment.<\/p>\n<p style=\"text-align: justify;\">Grover said that individual applications to withdraw the prosecution can be a tedious and cumbersome process, and were subject to the uncertainty of judicial approval. She cited one Patna FIR, which mentioned over 5000 unidentified persons, and said that such &#8220;catch-all&#8221; FIRs can be used to trap anyone.<\/p>\n<p style=\"text-align: justify;\">Mehta sought a few days to finalise the reply and agreed to share a chart of the FIRs. Justice Bagchi said that the Court can &#8220;engineer&#8221; a process for the quashing of the FIRs.<\/p>\n<p style=\"text-align: justify;\"><b>Senior Advocate Gopal Sankaranarayanan, <\/b>for some other petitioners, sought clarification of the July 28 order which allowed the States to proceed with the investigation. He also said that the petitioners are seeking action against certain named officers, whose acts of violence were caught on videos.  <i>&#8220;A direction has to go to the Commissioner of Police and the RAF Director to ask them how you permitted pellet guns and lathi charge. The police cannot be permitted to act like this. There is no question of it. We have placed videos. We are inviting the court&#8217;s attention to this serious issue. Let the affidavit answer these questions. The responsibility has to be fixed,&#8221; <\/i>he submitted.<\/p>\n<p style=\"text-align: justify;\"><b>Senior Advocate Dr Abhishek Manu Singhvi <\/b>submitted that the term &#8220;criminal antecedents&#8221; be clarified so that students who face petty offences like driving violations do not face harassment. When the Solicitor said that there were persons with murder and rape charges, <b>Senior Advocate N Hariharan <\/b>raised the issue of biometric surveillance and facial recognition technology. <i>&#8220;The only way the government has identified all the protest goers is by using facial recognition technology. This needs to be examined. We have not given consent for use of our biometric data,&#8221;<\/i> he submitted.<\/p>\n<p style=\"text-align: justify;\"><b>Senior Advocate Colin Gonsalves <\/b>raised <a href=\"https:\/\/www.livelaw.in\/top-stories\/advocate-moves-supreme-court-alleging-assault-by-delhi-cops-during-police-station-visit-to-meet-detained-student-protesters-543117\" target=\"_blank\" rel=\"noopener\">the issue of an advocate<\/a> who allegedly faced assault at the Nizamuddin Police station when he went there to meet detained protesters. He said that it was a serious issue affecting the very administration of justice.<\/p>\n<p style=\"text-align: justify;\">The Chief Justice said that police officers who indulged in brutalities should not be protected.  <i>&#8220;A police officer involved in excessive force should not be unduly protected. And it should not be that a hardened criminal under the garb of student protest is also getting protected,&#8221;<\/i> the CJI said.<\/p>\n<p style=\"text-align: justify;\"><b>Senior Advocate Shyam Divan <\/b>suggested that a former Chief Justice of India be appointed to monitor the Special Investigation Team. <\/p>\n<p style=\"text-align: justify;\"><b>Vrinda Grover <\/b>also <a href=\"https:\/\/www.livelaw.in\/top-stories\/delhi-protesters-allegedly-hit-by-pellets-move-supreme-court-seeking-ban-on-pellet-guns-in-civilian-protests-543104\" target=\"_blank\" rel=\"noopener\">raised the petition<\/a> against pellet guns, and said that her research showed no document authorising its use against civilian protesters. The CJI said that the Court will lay down a protocol on how pellet guns can be used.<\/p>\n<p style=\"text-align: justify;\">The bench posted the matters for further hearing on August 18.<\/p>\n<p style=\"text-align: justify; \"><b>Background  <\/b><\/p>\n<p style=\"text-align: justify;\">The Court was hearing a batch of petitions alleging excessive use of police force against students who participated in protests across the country from July 20 onwards over examination paper leaks and other alleged irregularities. The petitions concern incidents in Delhi as well as Assam, Bihar, West Bengal, Uttar Pradesh, Madhya Pradesh, Maharashtra and Kerala. Petitions have also been filed on behalf of injured police personnel and media persons.   <\/p>\n<p style=\"text-align: justify; \">At the previous hearing, the Court <a href=\"https:\/\/www.livelaw.in\/top-stories\/supreme-court-to-order-sit-probe-into-student-protest-violence-directs-release-of-detained-students-with-no-criminal-background-543164\" target=\"_blank\" rel=\"noopener\">observed<\/a> that the allegations prima facie made out a case for an independent and impartial investigation. The Court indicated that it may constitute a Special Investigation Team headed by a former Supreme Court judge and sought responses from the Union, Delhi Government and the States concerned. Solicitor General Tushar Mehta also accepted the Court&#8217;s suggestion for an independent investigation under the monitoring of a retired judge appointed by the Court.    <\/p>\n<p style=\"text-align: justify; \">The allegations placed before the Court include the use of pellet guns and shock batons, injuries to protesters, assault of an advocate, violence by police personnel in civil dress, alleged molestation of women protesters and the use of lathis with nails. The Court was also told about alleged police violence in Bihar and the detention of minors. The petitioners sought an independent probe and uniform protocols governing the use of force during protests.   <\/p>\n<p style=\"text-align: justify;\">The Court directed the preservation of CCTV footage, drone footage, body-worn camera recordings, videography, wireless communication records and PCR logs relating to the protests. It also directed the authorities to preserve protesters&#8217; personal information and digital data and not disclose or publish such information for the time being.   <\/p>\n<p style=\"text-align: justify;\">While allowing the States and the Delhi Government to continue investigations into the FIRs registered over the protests, the Court directed that no coercive measures be taken against protesting students who have no criminal antecedents. It further directed all States to release children below 18 years detained or arrested in connection with the protests if they have no criminal antecedents, if necessary on execution of a simple bond by them or their family members.   <\/p>\n<p style=\"text-align: justify; \">One of the petitions, filed by Advocate Shailendra Mani Tripathi, seeks regulation of police action during public protests, including a ban on deployment of plainclothes personnel for crowd-control duties, guidelines governing prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita and an independent probe into the July 20 police action in Delhi. The petition alleges that at least 60 protesters were injured.   <\/p>\n<p style=\"text-align: justify;\">Rajya Sabha MP Manoj Kumar Jha has separately <a href=\"https:\/\/www.livelaw.in\/top-stories\/supreme-court-rajya-sabha-mp-manoj-jha-police-force-cjp-student-protest-neet-542973\" target=\"_blank\" rel=\"noopener\">sought registration of FIRs<\/a> over alleged police brutality and disproportionate police action against protesters between July 20 and July 25. He has sought State-level SIT probes comprising the Director General of Police and two senior women IPS officers not below the rank of Inspector General, guided by a retired High Court judge and monitored by the Supreme Court. He has also sought pan-India guidelines or uniform national standards governing the use of force during public demonstrations.   <\/p>\n<p style=\"text-align: justify;\">The batch also includes applications alleging specific instances of police excess. Advocate Manik Gupta has alleged that he was assaulted and abused at the Nizamuddin Police Station on July 23 when he went there following distress calls from detained students. Junaid Malik, who volunteered to distribute food and water during the protests, has alleged that Delhi Police officials illegally detained and intimidated him, accessed his mobile phone and later abandoned him near the Dehradun-Mussoorie Road. He has also alleged coercive police action against his family members.    <\/p>\n<p style=\"text-align: justify; \"><b>Case: Shailendra Mani Tripathi v.
