Delhi MACT Compensation: Compensation of ₹1.52 crore in 100% Disability Case. Know the Accident Claim Process

Delhi Motor Accident Claims Tribunal has ordered a compensation of Rs 1.52 crore to the victim of a serious road accident. This case is related to an accident involving a high-speed car in February 2022, in which the victim Bharat Ghai became 100 percent permanently disabled.

In this accident that took place in Delhi on 11 February 2022, a speeding car hit Bharat Ghai. According to the tribunal, the accident was caused by rash and negligent driving, which caused serious head injuries to the victim. Due to these injuries he suffered hypoxic brain injury. Bharat Ghai went into coma after the accident and is now completely bedridden.

What did MACT say?

Tribunal Presiding Officer Sudeep Raj Saini said in the order given on March 16, 2026 that the condition of the victim is such that they are completely dependent on others even for their daily needs. They require constant medical care and nursing. The tribunal acknowledged that the victim would require the services of at least one full-time attendant throughout his life. The amount of compensation has been decided on this basis. This covers medical expenses, future care, pain and suffering, loss of income and other damages.

What should be done to take such a claim?

If such an accident ever happens to you, you can also legally complain about it and claim compensation for the loss caused. The procedure for claiming compensation under the Motor Vehicle Act, 1988 (Section 166) is as follows-

1. Report the accident to the police immediately: First of all, lodge an FIR in the nearest police station. FIR is a mandatory document for claim, which proves the date, time, place and circumstances of the accident.

2. Notify the insurance company: Inform the insurance company of the owner/driver of the vehicle involved in the accident as soon as possible. If you are a third-party, get their insurance details.

3. Collect necessary documents: Collect copy of FIR, medical reports (MLC, disability certificate), treatment bills, doctor’s report, statements of witnesses, photos/videos of the accident, vehicle documents, income proof of the victim (salary slip etc.).

4. File a claim petition with the Motor Accident Claims Tribunal (MACT): The claim is filed under section 166. File it in the MACT where the accident occurred, the victim/claimant resides or the address of the insurance company/driver/owner.
